Technician Fired Due to Lack of Work, Not Injury

A radio technician fired 6 days before he was scheduled to return to work from a non-work related concussion sued for disability discrimination. The employer denied the claim, arguing that the technician was fired due to lack of work. The Human Rights Tribunal ruled that the employer had proven that it fired the technician for legitimate business reasons based on the economic downturn. Other than the timing of the decision, there was no evidence supporting the technician’s suspicions that his injury was a factor in his termination [Hill Spectrum Telecom Group Ltd., [2012] O.H.R.T.D. No. 127, Jan. 18, 2012].
