Seasonal Worker Wins $10,000 Discrimination Lawsuit

For 4 years in a row, a seasonal quarry worker suffered a work injury covered by workers’ comp. In year 5, after undergoing abdominal surgery, he wasn’t recalled. The worker claimed disability discrimination; the quarry claimed the worker quit voluntarily. In a he said/he said case, the Human Rights Tribunal found the worker more credible. Result: The worker was fired and his injury was at least one factor in the decision. So the quarry had to pay him $10,000 in damages [DeForest v. Brockton Farm Ltd., [2012] O.H.R.T.D. No. 1635, Sept. 4, 2012].
