Drivers Can’t Bring Class Action Against Uber for Hacking Attack

In 2016, Uber was the victim of a hacking attack that compromised files containing personal information on the company’s drivers and customers. A group of those victims teamed up to file a negligence class action lawsuit against the company. Even if we did commit negligence, Uber argued, there was no evidence documenting the extent of losses, if any, suffered by the class and its individual members as a result of the breach. The Alberta court agreed and tossed the case. But while barring a class action, the ruling doesn’t prevent victims from suing Uber individually [Setoguchi v Uber B.V., 2021 ABQB 18 (CanLII), January 8, 2021].
