Workplace Harassment and Violence Prevention Policy

OHS laws require employers to implement measures to prevent workplace harassment and resolve incidents that occur. Here’s a template you can adapt for your own workplace. Caveat: This template is based on federal OHS regulations, because they’re the most advanced model and the one other jurisdictions are moving toward. However, the federal requirements, which are also now being applied to some degree in Alberta, New Brunswick, Newfoundland, Prince Edward Island, Quebec and Yukon, are also more stringent than those of other jurisdictions, particularly the requirements for investigating and resolving complaints of harassment set out in Section 10.

Are You Prepared For An Incident Of Workplace Violence In Your Workplace?

Many of us were stunned to witness Will Smith slapping Chris Rock live on stage at the 2022 Oscars award show. Fallout from that incident is still continuing to mount for Mr. Smith, although he has publicly apologized and announced his resignation from the Academy of Motion Pictures Arts and Sciences. While this blog will not be transitioning to cover arts and entertainment anytime soon, we do think this incident provides an interesting backdrop to discuss issues of workplace violence. As an employer, what would you do if your employee, Will, suddenly, in the middle of a workday, struck his co-worker, Chris?

Lorenzo Lisi of Aird & Berlis LLP will lead this session with an in-depth overview of employer’s legal obligations with respect to harassment, bullying and violence in the workplace.

In Canada, OHS laws include due diligence which means employers shall take every reasonable precaution to prevent injury and incidents in the workplace – including taking actions to prevent harassment, bullying and violence. When workplaces are unhealthy it affects absenteeism, retention, recruitment, the company reputation, productivity, morale.
