Hi there, We have an employee who has worked for us for 1 1/2 years in one of our warehouses as a Machine Operator. He gave written notice he is quitting and his last day in the note is 4 weeks from now. We told him we didn\’t require him to stay so he left that day. Can I just pay out the 2 weeks required by law at that point or am I paying out the 4 weeks? Thanks for your help

I’m pretty sure you’d only have to give him the required 2 weeks. Logically, there’s no way the ESA would allow employees to unilaterally increase their own termination notice entitlement by giving longer notice of their intention to quit. But there may be something I’m missing so I’m going to run this Q past our payroll expert, Alan McEwen. Will let u know when I hear back.
