Example: In SK, we want to reduce staff as there is no need for so many. However we would like to keep an employee who has been with us for 4 months as she’s a leader, however that means we have to lay off the employee who has been with us for over a year. Would this cause problems? We are non unionized.
If the retaining employee in question has a more senior role in the organization, then there should be no issue. If, however, the role is implied and the responsibilities are the same, then the longer term employee could have a case to challenge the layoff.
