Ask the ExpertCalculating Pay in Lieu of Notice
Breanne Lazowski asked 1 month ago

We have to terminate an employee as their role is no longer needed on site. The individual works a week on, week off schedule…based on tenure they are entitled to 4 weeks. The individual alternates between day shifts and night shifts….do we need to include their night shift premium when calculating the pay in lieu of notice or do we just refer to their hourly rate? In Alberta, the wages in lieu of notice have to be the wages the person would have earned had they worked their regular hours, for the length of notice required.
This means that yes, the night shift premium needs to be taken into account in what the employee needs to be paid in lieu of a notice period.
