      Joe Smith’s sign out time from his shift ending on Nov 24th was at 11pm. He signed in for his next shift on November 25th at 6am which was only 7hrs rest period between shifts. Does he get 1hrs overtime on Nov 25th from 6am – 7am as Employment Standards states there should be 8hrs rest period between shifts?

      Are split shifts confined to a 12hr period?.

      If the first shift starts at 7:00 a.m., the second shift must end no later than 7:00 p.m.

        Saskatchewan requires a minimum 8 hours between shifts, so Joe would be entitled to 1 hour of overtime.

        All split shifts are within 12 hours and/or the calendar day. For example, 8-12pm and 4-8pm is a split; 8-12am and 4-8am is not.

          Is it 12 hours or 24 hours? Below is from the Saskatchewan website. Short shifting and split shifting are two separate concepts? What is the difference? Thank you.

          Short-shifting
          For the purpose of calculating overtime, the employee’s work “day” begins with the start of the employee’s first shift and ends 24 hours later. All hours worked within that 24-hour period count towards the overtime threshold.

          Example:

          Date Shift Starts Shift Ends Hours Worked
          May 3 3:00 p.m. 11:00 p.m. 8 hours
          May 4 7:00 a.m. 3:00 p.m. 8 hours
          During the 24-hour period, beginning 3:00 p.m. on May 3 and ending 3:00 p.m. on May 4 the employee worked 16 hours. This employee must be paid eight hours regular pay and eight hours overtime pay.

            In this particular example, there is 8 hours between the shifts and a new calendar day, the employee would not be entitled to overtime.
