For an employee who takes maternity and parental leave in British Columbia, Canada, and has previously requested for a full maternity leave and a year of parental leave but now after six months requests to return to work, what is the employer’s and employee’s rights? Can employer deny the employees request to return to work earlier than agreed?
If the employee requested to return earlier than the end of their maternity leave and not take parental leave, what would be the case? Can the employee return early or the employer has the right to deny their return until they had already agreed?
