    I work for a federally regulated employer and I would like to know if we can ask for an employee’s nationality once they are hired? Also, can you provide the legislation to support the answer so I can use it as a reference? Thank you.

    Section 3 of the Canadian Human Rights Act makes it illegal for federally regulated employers and service providers to discriminate against people, or treat them unfairly, based on the following grounds:

    • race
    • national or ethnic origin
    • colour
    • religion
    • age
    • sex
    • sexual orientation
    • marital status
    • family status
    • disability
    • a conviction for which you have been granted a pardon.

    Employers have a duty to not to discriminate and asking an employee or interviewee any of these could get you into hot water. Here’s the legislation.
