    Hello,
    Looking for what the precedence is for determining the termination notice (employment standards – Alberta) for an employee who has worked for the company, was laid-off then returned and subsequently laid-off again. Would you use the period for how long the worker has been employed for the most recent term, or would you use the total time that the employee worked for the company? Does it matter how much time was in between the two periods of employment with the company?

    The “precedent” would be total active employment minus the periods of layoff, if they were layoffs and not a rehiring scenario. However, you should also consider economic conditions, age, ability to find comparable work, and skills, as these will play a role in determining the amount of severance/working notice if it was challenged by the employee in mediation and/or court.
