    Can an employer ask an employee who is preparing to go on maternity leave in a letter, to pay back pay back the employers paid premiums of the medical/dental benefits IF the employee decides not to return to work after the maternity leave is over? In our company the Employer pays 75% and the employee pays 25%.

    I think the short answer is no:

    1. This would be an attempt to change the terms and conditions of work for an employee because of a protected ground.
    2. If this only applied to people who went on a maternity or parental leave, that in itself would be discriminatory.
