      Hi Glenn, require further information on the following, please:

      An employee in May 2019 signed a “3 year pay increment” document as follows:
      May 1, 2019 $19 increasing to
      May 1, 2020 $21; another increase
      May 1, 2021 $23
      September 2019 she went on MAT leave
      She is expected to return back to work and has requested to get paid at $21.
      Is the employee entitled to the increase even though she has not performed?
      Also, will she be entitled to the May 1, 2021 $23 increase coming up as well – again in this short period of time?

        So the answer is another question.
        Were the pay increments conditional on active service or just on “employment”.
        If the later, then yes, the agreed upon hourly rates are binding on the employer.
