We are based in Ontario and we have an employee retiring in the coming weeks. There has been talk of having him return in a part time capacity down the road. Is there a recommended period of time that should pass before we look at having him return?

I don’t know of any laws that ban rehiring retirees for part-time work. But it may get tricky if the employee is receiving pension or other benefits that become payable upon retirement. In that case, you need to look at the terms of the plan to determine whether employees are allowed to continue receiving (and, for that matter, contributing to) their pensions if they come out of retirement and work for the company part-time. The plan may also dictate how long retirees must wait to return so that they can keep getting their retirement benefits. I hope that helps. Glenn
