We have an employee who takes lengthy prolonged bathroom breaks which add up to a total of 1.5 hours of lost production time per day which is affecting operations and negatively impacting his team.  Is there a sensitive manner in which to ask the employee if he has a medical issue and/or to discuss productivity concerns or is there too much legal risk associated with this topic?
