    Good afternoon,

    Please advise on the following:
    Employee start date March 30, 2023.
    Driver only in Ontario, has been involved in five (5) different incident/accidents spanning from December 2023 to present.
    1. Struck and damaged column panels.
    2. Damaged homeowner’s retaining wall.
    3. Damaging fuel tank, toolbox and front bumper.
    4. Damaged homeowner’s interlock driveway.
    5. Struck and damaged overhead wires (fire, police and hydro were called and repaired damage caused).
    All the above were written on three different warning letters and given to driver.
    Can the company give the driver a “Last and Final” warning and should there be another incident/accident he will be terminated with cause?
    Please advise on what the company can and cannot do.

    Hi Mirella! I am so sorry to hear about these incidents – this is very difficult to deal with as an employer and you have been very forgiving. Since these are dealing with legal matters like property damage and safety concerns for your clients and other employees, I would highly consider not just termination but also seeking out legal advice. This is beyond an Ask The Expert and I don’t want you to suffer any more as an employer or a company! You want to follow the best legal pathway possible and avoid any turmoil.
