    Hello, an employee requested to his regional manager he wanted to take a course.
    He is a heavy equipment operator and decided to take an AZ license course.
    The worker did not mention anything to his reporting manager as he was unaware until the night before the course was to commence.
    The worker requested a layoff or leave of absence and asked to work part-time.

    The Company does not offer part time work and we are not in a position to lay the worker off as we have work for him as a heavy equipment operator – which is what he was hired for.

    The worker started his course (we think it is a 2-month full time driving course (which is not related to his current position) as of January 23rd, 2024, and he is not coming into work. Can we assume has resigned from his position?
    We did email him asking if he resigned from his post and he stated no.
    Does the employer have the right to send a registered letter requesting him to show up for work by a certain day and if he doesn’t basically, he has abandoned his position, which means he has resigned?
    Please advise us what we need to be informed of.

    Yes, the employee did not have previous consent to take the course, or approval of leave of absence.

    We would recommend that you follow the steps associated with job abandonment and start the termination process, as opposed to it being a resignation.
