Worker’s Pain was Typical of Injury and Not Chronic Pain

A worker sought compensation for massage therapy for his back injury. An appeal tribunal explained that chronic pain justifying such compensation “must be out of proportion to the permanent medical impairments.” It is pain that continues “beyond the normal recovery time for an injury” or pain out of proportion to that expected with such an injury. Medical experts found the worker’s pain was typical for his injury and that massage therapy wasn’t likely to be more effective treatment than home exercises. The tribunal ruled the worker failed to show that massage therapy was appropriate and thus wasn’t entitled to compensation for long term massage therapy
