Worker Fired for Refusing Vaccination Sues Union for Not Grieving

A pipefitter who got fired for defying his hospital employer’s mandatory COVID-19 vaccination policy sued the union for not filing a grievance on his behalf. The Newfoundland labour relations board ruled that the union didn’t breach its duty to represent the pipefitter fairly and tossed the complaint. There was nothing arbitrary or discriminatory in the union’s decision not to challenge the termination, especially since the pipefitter’s refusal to get vaccinated was due not to any disability but subjective beliefs about the risks and benefits of vaccination [Gamberg v United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada, Local 740, 2022 NLLRB 2 (CanLII), April 8, 2022].
