Can an employee be terminated during unpaid leave due to covid?  Our business happens to loose a client and no work will be available for this particular employee. Can we terminate this person when they are on unpaid leave of absence due to covid related family issues?  We are non – union business.

No, unless you’re willing to pay the employee termination notice and other ESA benefits. If you want to go that route, you must negotiate a severance agreement providing at least the person’s ESA and contractual entitlements in return for his/her agreement to release and not sue your organization.
