What documentation do we need to justify terminating an employee for violating a safety rule?
You need documentation showing that, at a minimum:
- You had a clear and specific safety rule;
- The employee knew about or should have known about the rule because you communicated it to him/her;
- The employee violated the rule;
- You enforce the rule consistently and terminated other employees for violating it.
If this is a repeat offence and/or the employee has a prior disciplinary record, you also need documentation of the other offences he/she committed and the other disciplinary measures you imposed in response, e.g., warnings, suspensions, demotions, etc.
