No Negligence for Bombing of Mine during Strike

Our vote for case of the year was the denial of a territorial court to hold a mine owner and other defendants liable to families of miners who were killed in a bomb blast during a bitter strike. The bomb was deliberately set off by a striking miner. The court ruled that the act of violence was unforeseeable and the defendants weren’t negligent for failing to prevent it [Fullowka v. Royal Oak Ventures Inc., [2008] N.W.T.J. No. 27, May 22, 2008].
